Terms and Conditions

  1. Agreement and Scope

This document describes the agreement between the Client and Nicola Johnson of All About Ancestors (the Genealogist) regarding the contracting of DNA and genealogical research services. If the Client agrees with these terms, they should confirm by email. The agreement becomes effective once accepted and a deposit has been paid.

  1. Services Provided

Services may include: reviewing information provided by the Client; formulating a research plan; genealogical and/or DNA research; analysis of evidence; evaluation of results, trees, and documents supplied or uncovered. The Genealogist will use professional judgement to carry out the work in the most productive way to meet the Client’s goals.

  1. Engagement Terms & Client Responsibilities
  • All work and family information is treated as confidential and will not be shared without written permission.
  • The Genealogist will not exceed the commissioned hours without prior agreement.
  • Paid time includes research, analysis, reporting, and all communication by email or phone/Zoom.
  • Unused pre-paid hours will be refunded where work takes less time than expected.

  1. Previous work
  • The Client should provide key dates and places (birth, marriage, death), details of major life events, and any sourced records already obtained. Access to existing online family trees or a GEDCOM file is also encouraged to avoid duplication of effort.
  • Please note that any time spent uncovering information already known to the Client but not disclosed before research begins will still be chargeable.
  • The Genealogist may need to check supplied information if it is unsourced or contains errors.

  1. Reporting of Research Outcomes

Traditional GenealogyReports (or Zoom meetings) include:

  • Client brief
  • Information on all work undertaken laid out in an easy-to-understand format
  • Findings
  • Source references
  • Evidence
  • Negative findings and unsuccessful searches (which are chargeable work)
  • Copies of documents (where permitted by copyright, licensing and/or other restrictions) or translations/transcriptions of documents where applicable
  • Pedigree charts, family group sheets and other charts to illustrate the research where appropriate
  • Recommendations for further research

DNA Research – DNA Evaluations & Research Hours:

The Genealogist will report DNA evaluation results via online Ancestry trees or via Zoom meetings, sharing their screen to explain actions taken and conclusions reached. With the Client’s permission, the meeting will be recorded and a downloadable copy provided, along with a short written summary of conclusions and recommendations for further research. If the Client cannot use Zoom, a traditional phone call can be arranged. A full written report may be possible for an additional fee, but because writing up extensive DNA evaluation is time-consuming, this option is generally not cost-effective.

  1. Fees & Expenses
  • Fees agreed in advance: blocks of 10 hours (£450).
  • Reasonable expenses will be reimbursable by the Client; these could include travel, entry fees to archives, the cost of records/certificates, use of online credits, postage, photocopying and printing
  • Certificates are charged at cost price
  • Travel is charged at 45p per mile.

  1. Payment Terms
  • For commissions under £180: the Genealogist requires full payment in advance.
  • Commissions over £180: the Genealogist requires 50% deposit in advance, with the remainder due on completion and before delivery of report and associated documentation.
  • Payments must be in Pounds Sterling (GBP) unless otherwise arranged with the Genealogist
  • Payment can be made by Bank Transfer, Cheque, PayPal or Cash (in person only)

  1. Cancellation

The Client has the right to cancel this agreement within 14 working days of confirming by email. As it is in the Client’s interests for research to begin promptly, confirmation by email authorises the Genealogist to commence work immediately. If the Client later chooses to cancel, notice must be given in writing by email. The Client will be liable for any work completed up to the date of cancellation. The cost of this work will be deducted from any payment already made.

After 14 days, the Client is liable for the full agreed amount.

  1. Data Protection

By agreeing to these terms and conditions the Client agrees to the Genealogist holding personal information as it is necessary to conduct the research on the Client’s behalf, and as they are required by law for a minimum period of 5 years.

  1. DNA use
  • If the Client commissions DNA research, by agreeing to these terms and conditions the Client agrees to share their DNA test results with the Genealogist and to the Genealogist uploading the Client’s raw DNA to third-party databases.
  • If the Client gives the Genealogist access to login/password information for DNA testing sites or DNA raw data, this contract notes that the Client consents to the Genealogist holding and processing this data.
  • DNA research may reveal unexpected upsetting results, for which the Genealogist accepts no liability
  • Clients may request removal of their data at any time, though this may prevent completion of the research.

  1. Use of Other Researchers

On some commissions it may be necessary for the Genealogist to instruct additional researchers, either due to the distance of the relevant record repositories, or the need for specialist expertise. In such cases, researchers will be carefully chosen for their suitability and standard of work, and the Client will be consulted before any instruction is given. While the Genealogist will exercise due diligence in their selection, they cannot be held responsible for errors or omissions made by third parties.

  1. Likelihood & Limitations

Outcomes cannot be guaranteed. Research time covers both positive and negative results. Please note that it is not always possible to trace a family as far back as hoped, to locate specific records, or to resolve a DNA query. Research time includes both positive and negative results, as even ruling out documents or lines of enquiry is a valid outcome. Fees (including expenses, where applicable) are payable regardless of whether the desired information is found.

  1. Copyright & Future Use
  • All work is copyright of the Genealogist. Copies may be made for personal use only and must retain attributions.
  • The Client may make a small number of personal copies of copyrighted reports but agrees to not otherwise publish or make multiple copies without written permission.
  • The Client further agrees that if they make limited distribution of anything that includes the Genealogist’s research, in whole or in part, they will report it accurately and credit the source.
  • All attributions, document footers and copyright statements must be retained in any copies.
  • The Client should also be aware that copies of any documents or other materials supplied with the report may be subject to third-party copyright and should not be reproduced or sold on in any way without the express written permission of the original copyright holder.
  • Zoom recordings must remain confidential and should not be shared without the express permission of the Genealogist.
  • Likewise, DNA Ancestry master research trees remain the property of the Genealogist and cannot be shared by the Client without the express permission of the Genealogist.

  1. Limitation of Liability

The Genealogist’s liability is limited to the contract value. Responsibility is not accepted for errors in third-party records or by contracted third parties.

  1. Accreditation & Professional Standards

The Genealogist is a member of the RQG and an AGRA Associate, adhering to their Codes of Practice.

  1. Disclaimers

The Genealogist cannot guarantee successful outcomes, predict whether a search will be successful or unsuccessful, or guarantee that DNA mysteries will be solved, or that living relatives will agree to contact. The Client further understands that DNA testing can provide shocks and the Genealogist may conclude that certain ancestors (including parents/grandparents) are not their biological ancestors.

  1. Complaints

In the unlikely event of the Client not being happy with the research received, the Genealogist will endeavour to address any issues as quickly as possible and agree a recompense where appropriate. If the Genealogist is unable to resolve your complaint satisfactorily, they would refer you to the RQG’s Resolution Procedure, which can be found at the Register of Qualified Genealogists.

  1. Governing Law

The law applicable to this agreement shall be the law of England and Wales.

  1. Non-performance

In the event of illness, incapacity, or death, the Genealogist (or their executors) will provide all completed work to date and refund any balance after deductions.
